The importance of intellectual property in today’s technology-driven industry has always increased. Patents are an important IP asset for an organization.  A company’s IP portfolio should include patents. As a result, an organization’s capacity for innovation can be evaluated by looking at its patenting methods.  The quality of the patents, not just their quantity, is what raises the corporation’s standards. We are all aware that obtaining a patent is an expensive and  time-consuming process. Thus, it is always suggested to approach the process of getting patents strategically.

The commonly used term of International Patent should not be confused with the grant of patent internationally. The patent is territorial. It means, to protect an invention in India, the patent has to be granted in India and similarly elsewhere as well. There is no worldwide patent that can give protection through a single application.

Following are some of the PATENT SERVICES that we provide:

First one is Patent Search :

A grant of the patent is a long process that entails in itself multiple checks on novelty, non-obviousness and industrial applicability. For this, it is very important to have a solid check on prior art to understand the patentability of the invention. Moreover, the steps that are involved in developing an invention and making it are time-consuming and costly. It is highly advisable to conduct a strong prior art search. For this, conducting a patent search is always the first step in the way of filing the patent application. Having a strong search ensures a strong patent application.

Second service is Patent Drafting:

We  have extensive experience and competence in drafting Indian patent applications (both provisional and non-provisional). All draughts are examined and checked for  quality using checklists.  It is necessary that the drafting must be done in a way that does not leave any stone unturned when it comes to the disclosure being made for the invention.  We make sure that the description of the innovation covers all conceivable modifications. Transstellar team drafts  complete applications as per the defined statutory requirements of the patent office where the application is to be filed. All drafts are reviewed and verified against a client approved quality checklist. It is ensured that all likely variations of the invention are anticipated and covered in the description.   We put emphasis on the following when developing an Indian patent application:

Flawless comprehension of the invention with the help of disclosure provided by you

Third service is Patent Filing and Application:

Patent filing in India is an elaborate and complex process, in which an applicant / inventor may waste a good amount of time if not well assisted by professionals  who have expertise in patent filing. Incorrectly filled up forms may lead to loss of the priority right and / or may delay the priority date. Even after filing of the patent, there are other documents that need to be filed within prescribed timelines, such as a request for examination.

A patent application without claiming priority of prior application refers to an ordinary application, which can be a provisional or a nonprovisional patent application.

We at Transstellar utilize the E-filing of the Indian Patent Office to file the patent application for the grant of a patent and pay official electronic fees and furnish  a patent specification with ease.

The non-provisional application will be filed directly or within 12 months from the provisional filing date.

Conventional Application:

A patent application that claims a priority date and priority of substantially similar inventions filed in one or more convention countries of the Paris convention  refers to a convention patent application. The convention patent application is filed within 12 months from the date of the priority application.

We need a patent specification [in English] and priority application details to file a conventional patent application in India. Further, a certified copy of priority  documents must be submitted to the patent office. These priority documents can be provided at the time of filing or within three months from the date of communication  from the Patent Controller.

Divisional Application:

A patent application may be divided into the further application(s) in respect of the invention(s) disclosed in the main patent application. Such divided application  refers to the divisional patent application. The date of filing, priority date, and the term of the patent for the claims of the divisional application shall be the  same as of the main application.

In the patent registration, the patent prosecution phase includes all the communications to and from the Indian Patent Office from the time of filing the patent application to the grant of the patent. After the patent grant, the patent will be in force only when the patentee pays the annuity fee regularly. In the patent registration services, we provide patent services from the patent search till publication.
